NSW:Marshall assault charge thrown out=2
The 26-year-old had denied punching Mr Naimey, 25, outside a McDonald's restaurant
in Sydney's CBD in the early hours of March 5.
He gave evidence saying he had pushed Mr Naimey after he racially abused him, but Mr
Naimey said he was punched after he told the footballer that Broncos player Darren Lockyer
was better than him.
The magistrate noted a number of witnesses had referred to a second man having punched
Mr Naimey, who ended up with a "fat lip".
Even if the footballer had punched him, "I must have a reasonable doubt as to whether
or not (the fat lip) was occasioned by Mr Marshall," the magistrate said.

28 April 2011 - Norwegian IT group Atea ASA (OSL: ATEA) said today it generated a net profit of NOK88.4m in the first quarter of 2011, up from NOK73.8m in the previous year.
Operating revenues surged 30.2% on the year to NOK4.65bn beating the NOK4.535bn market consensus. Claus Hougesen, CEO, said he was very satisfied with a double-digit growth in a market which will expand by 6.3% in 2011, according to the International Data Corporation (IDC).
Hardware sales improved by 34.8%, services were up 36.6% and software sales jumped 10.0%.
EBITDA rose 34.6% on an annual basis to NOK161.1m. The EBITDA margin went up to 3.5% from 3.4% a year earlier.
In the first quarter, Atea generated an operating profit of NOK109.7m, up 44.1% on the year. The result is lower than analyst forecasts for NOK114m.
The IT company retained its target for an operating revenue of NOK20bn and EBITDA of NOK1bn in the full 2011.

Fed: RAAF aircraft damaged in incident over Afghanistan
CANBERRA, April 22 AAP - An RAAF aircraft damaged in the air over southern Afghanistan
managed to return safely to base earlier this month.
Defence says the incident, on April 8, occurred when a countermeasure flare on a AP-3C
Orion surveillance aircraft, used to decoy attacking missiles, went off inadvertently.
Defence described the incident as the irregular release of one of the aircraft's counter-measure
flares due to a systems malfunction.
"The crew ceased their assigned mission and safely landed the aircraft at Al Minhad
Air Base in the United Arab Emirates," defence said in a statement.
The aircraft was assessed on landing, indicating damage to the airframe that required
a technical and air safety investigation, which is now underway."
Australia operates two AP-3C aircraft from Al Minhad Air Base.
They fly extended surveillance missions over the Persian Gulf and also over Afghanistan
in support of coalition ground operations.

CANBERRA, Dec 8 AAP - It's a bit like the Time Warp from the Rocky Horror Picture Show.
Except Tony Abbott has neglected the jump to the left and gone for a lurch to the right.
In crafting his new shadow ministry, Abbott has elevated some of the most polarising
figures from the former Howard government - Kevin Andrews, Philip Ruddock and Bronwyn
Bishop.
Together Andrews - in families and human services - and Bishop - in seniors - will
be the face of coalition welfare policy.
They're not the only conservatives to be rewarded in the new line-up.
Nick Minchin, Eric Abetz, Cory Bernardi, Barnaby Joyce and Mathias Cormann - all critics
of Malcolm Turnbull's climate change policy - are some of the biggest winners from the
reshuffle.
Abetz will prosecute a new, more hardline approach to workplace relations, and Minchin
will be in charge of the resources and energy policy.
The likes of Andrews, Ruddock, Bishop and Joyce will be a gold mine for Labor campaign
strategists looking for golden moments to use in campaign advertising for the next election.
Anthony Albanese, Labor's chief headkicker, gave a taste of the line of attack the
Rudd government will use against an Abbott-led coalition.
"What we have seen today is final proof that the extremists and climate change deniers
have taken over the Liberal Party," he said.
Abbott has given them plenty of ammunition.
Despite protestations of a balanced team, key Turnbull supporters were dumped from
shadow cabinet - Michael Ronaldson, Steve Ciobo and Michael Keenan - and Andrew Southcott
was banished from the ministry altogether.
Abbott maintains the moderates have done okay.
Joe Hockey and Chris Pyne have retained their jobs - as shadow treasurer and the education,
apprenticeships and training portfolio, respectively.
Scott Morrison in immigration and Greg Hunt in climate action will be in charge of
two of most important policy issues in the lead-up to the next federal election.
How much rope Abbott gives them to develop a more palatable, centrist policy will play
a crucial role in whether the voters see his leadership as conservative - or extremist.
The preliminary polling on the Abbott ascendancy confirms he is popular among the Liberal
Party base.
To win government, Abbott needs to take back the centre of the political spectrum,
which Prime Minister Kevin Rudd has masterfully made his own.
In rewarding his conservative backers, Abbott will have to be careful.
He may have to keep some on a leash to ensure they don't resort to their past controversial
behaviour.
Madness, after all, can take its toll.

MELBOURNE, April 30 AAP - What should a nation make of a man like Richard Pratt?
For the past couple of weeks it has heard at length of the many virtues possessed by
a man described as the "quintessential Australian success story" and a "giant among men".
It has been reminded that Mr Pratt, who died on Tuesday, had arrived in Australia in
1938 with nothing and rose on a large stack of cardboard boxes to become one of its wealthiest
citizens.
He has been lauded as Australia's greatest philanthropist and one of its greatest environmentalists.
Mr Pratt's kindness, compassion and generosity have been extolled by leaders of the
community and the business world.
The adulation he attracted has few precedents.
John Elliott said he had cried when he heard of Mr Pratt's death and went on to describe
him as the greatest person he had known.
At his funeral, journalist, commentator and CEO of the Pratt Foundation, Sam Lipski,
eulogised him lovingly and loyally.
"We loved him because of who he was and sometimes despite who he was," Mr Lipski said.
"A great man and yet every man, a great Australian, wealthy and powerful, he knew how
to use his wealth and his power and yet he was every Australian."
Mr Lipski also touched, less than lightly, on one of the aspects of Mr Pratt's life
that is troubling to many in the community - and certainly to one Federal Court judge.
"Richard, we know, played many, many parts," Mr Lipski told mourners.
"The recent dramas in court, unfolding as he was near death and then continuing yesterday
after his passing, tells us what those who knew him and worked with him already knew.
"In this last act, Richard was cast in a play that should never have been produced,
a mean drama that was unjustly conceived and unjustly produced.
"We all know the mills of history grind slowly but I'm certain history will vindicate
Richard, his achievements, his generosity and his honour."
Mr Lipski was talking about the criminal trial that was abandoned as Mr Pratt lay on
his death bed.
The trial stemmed from the civil case resolved last year in which Mr Pratt agreed to
plead guilty and pay a $36 million fine - the largest in Australian history - for fixing
the price of cardboard.
In the civil case, Mr Pratt made certain admissions regarding the price fixing which
involved rival packaging company Amcor in the belief they couldn't be used against him
in any other proceedings.
Despite that arrangement having allegedly been agreed to by the Australian Consumer
and Competition Commission (ACCC), the same organisation used it to pursue Mr Pratt on
criminal charges.
On the face of it, the ACCC has behaved questionably.
Mr Pratt, according to his friend John Elliott, was innocent and only made the admissions
in the civil case in order to "clear the decks" and get the case out of the way.
"It could have cost him $150 million in legal fees and everything else if he'd fought
it," Mr Elliott said.
On the other hand, trial judge Justice Peter Heerey took to Mr Pratt in his judgment,
declaring the nation's then third-richest man had entered into a cartel arrangement for
his personal benefit.
Mr Pratt, the judge said, had robbed "every man, woman and child in Australia" over
the five years the cartel operated.
As a result, Mr Pratt handed back his two Order of Australia awards.
The other issue that history might have a problem with is the one concerning his mistress,
Shari-Lea Hitchcock.
Mr Pratt and Ms Hitchcock have an 11-year-old daughter, a situation which might sit
at an odd angle for anyone listening to the praise recently heaped on a man said to be
devoted to his family.
It is debatable whether the court verdict that said Australia's biggest giver was also
ripping off just about every member of the community, or the revelation that the philanthropist
was also a philanderer, will affect how history ultimately views Mr Pratt.
His name would appear out of place alongside the likes of Alan Bond, Christopher Skase,
Steve Vizard, Larry Adler or HIH's Ray Williams, men whose redeeming features were less
obvious.
Or would it?

WA: Child porn allegedly found on home computer
PERTH, Aug 19 AAP - A Perth man will face court today after police allegedly found
child pornography videos and pictures on his home computer.
Detectives raided his south suburban Maddington home on July 10, confiscating three
computers and analysing the hard drives.
They allegedly found 50 videos and 49 images of child pornography.
The 31-year-old man was arrested last Friday and was charged with two counts of possessing
child pornography.
He was bailed to appear in the Armadale Magistrates Court today.

HOBART, April 25 AAP - Miners Brant Webb and Todd Russell have marked the first anniversary
of the rock fall that trapped them underground and killed workmate Larry Knight by attending
Beaconsfield's Anzac Day dawn service.
The pair were rescued after spending 14 nights trapped in a tiny cage a kilometre underground
after a rock fall on Anzac Day last year at the Beaconsfield gold mine near Launceston
in Tasmania's north.
Today, they stood with about 100 of their friends and neighbours at Beaconsfield's
cenotaph - within sight of the mine and above the spot where they were trapped.
"That's probably why I was a bit edgy, you know. We could see the (mine's) head frame
from where we were and everything," Brant told the Nine Network.
For Todd Russell, the day was an emotional one.
"Anzac Day is a day for the remembrance of the returned servicemen, the Diggers and
that, but for Brant and me it's an even bigger, sadder day because of the loss our fellow
workmate Larry, so there's a lot of mixed emotions for us today," he said.
The Beaconsfield community and the RSL marked the day by honouring Australia's servicemen
and women as they had done in years past, but West Tamar mayor Barry Easther said the
mine was on everyone's mind.
"Anzac Day brings back unforgettable memories of what happened at 9.23pm on April 25
last year," he said.
"It is difficult to forget.
"Later today, after the Anzac remembrance service and lunch that normally happens here,
the thoughts of many people will turn to the accident at the mine.
"They will start to reflect on the experiences of the 14-day rescue."
Mr Easther said Beaconsfield was coping well a year on.
"We are a vibrant community and we have been blessed with large numbers of visitors
coming here because of the mine and what happened.
"People from all over the world have been touched by the story that came out of Beaconsfield
and they feel a real need to visit the place where it all happened.
"It's unbelievable. The mine shut after the accident, but the increased visitor numbers
have certainly helped the local economy."
The scars of the rescue remain. Brant admits he has trouble sleeping, while Todd said
he began seeing a counsellor three weeks ago.
Recently, he warned Brant not to see the film World Trade Centre, which depicted two
policeman trapped under the wreckage of New York's twin towers after the September 11
terrorist attack.
"I actually sat and howled and howled and howled because it gave me a perspective of
what (wife) Carolyn and the kids and mum and dad were going through," he said.
Todd said his thoughts were with Larry Knight's family today.
"There's not a day goes by when you don't think about Larry but it's probably going
to be a bit harder today because because you've got Jackie, his wife, and Thomas, his
little son and (son) Addison and (daughter) Lauren and all the family," he said.
"It must be so hard for them."
A memorial service for Knight and a concert to celebrate the rescue will be held in
Beaconsfield on May 9 - the anniversary of the rescue and of Larry Knight's funeral.

SYDNEY, Dec 25 AAP - The wheels of justice continue turning in Sydney today at Parramatta
Bail Court where a 20-year-old man will appear charged over a Christmas eve home invasion.
Police say two men broke into an Ingleburn home, in Sydney's south-west, about 10pm
(AEDT) last night and threatened two men inside.
During a fight that followed the invasion, a 24-year-old man was stabbed in the chest,
police say.
The alleged victim will spend today in a stable condition in Liverpool Hospital.
A 20-year-old man arrested by police after a chase through backyards in Ingleburn has
been charged over the violent home invasion.
He will face Parramatta Bail Court today charged with aggravated break-and-enter, maliciously
inflicting grievous bodily harm, and assault occasioning actual bodily harm.
Police are still searching for a second man.

A man's been arrested and charged with smuggling male hormones into Sydney .. through air mail.
Customs says it first became aware of the alleged illegal importation in May .. when
it found the male hormone testosterone in an air express mail package.
Customs says a number of other packages containing anabolic and androgenic substances
.. which are prohibited from being imported without a permit .. were intercepted while
being delivered to addresses in south-west Sydney.
In a joint operation with NSW Police .. customs raided several south-western Sydney
homes .. and a man was arrested on Monday as he walked out of a Sydney post office.
He's been released on bail to appear at Fairfield Court on September 5.
The prohibited charge carries a maximum penalty of 110 thousand dollars .. imprisonment
for five years .. or both.

MELBOURNE, April 11 AAP - Immigration Minister Amanda Vanstone has accused unions and
the federal opposition of inciting xenophobia by referring to skilled migrants as foreign
workers.
Speaking at a National Workforce Symposium in Melbourne today, Senator Vanstone blasted
criticisms levelled at the government's skilled migration program, saying the system was
crucial for addressing skills shortages.
Senator Vanstone said the campaign against the program was most likely linked to controversial
industrial relations changes and that claims of unskilled "foreign workers" being brought
to Australia and exploited were false.
"I don't like that (term foreign worker), this is a migrant country, unless you're
a full-blood indigenous Australian you've got migrant blood in your veins," Senator Vanstone
said in her opening address to the symposium, hosted by the Recruitment and Consulting
Services Association.
"We are a nation of migrants and I am not confident that talking about foreign workers
for people who come here as skilled migrants to help our businesses grow is at all a healthy
development.
"It is a very unwise person who follows that path of abuse or raising doubt and sneering
and questioning people coming from overseas."
Senator Vanstone said comments by Opposition Leader Kim Beazley referring to skilled
migrants coming from "Beirut, Bombay and Beijing" were inaccurate when 26 per cent of
Australia's intake under the program was from the UK.
"They're skilled migrants, we ask them to come here, they help Australian business
grow ... why on earth would we refer to them consistently as Mr Beazley does as foreign
workers other than to raise some form of xenophobia," Ms Vanstone told reporters after
her address.
"Why does he use in his criticism of this program Beruit, Bombay and Beijing, why didn't
he use Belfast or Birmingham or Bristol?"

A ground-breaking surgical procedure being trialled at The Alfred hospital in Melbourne
.. could spell the end of blocked noses for anyone suffering from sinusitis.
The world-first technique is called balloon sinuplasty .. it's been successfully trialled
on 10 sinusitis patients .. and is expected to gain commercial approval next year.
The procedure involves a balloon catheter .. which is inserted through the nostrils
and inflated to clear blockages and combat infection.
It's less invasive than traditional sinusitus surgery .. has no known side effects
.. and is believed to be permanent.
First trialled at The Alfred .. it's a two-hour operation performed under general anaesthetic.
Another trial will be conducted involving 50 patients at The Alfred hospital .. to
see how long the results last.

Last week, WENDY UTTING, a volunteer worker in the speaker's office named the MP at
the centre of the allegations.
Ms UTTING also named senior police and members of the judiciary as sex offenders --
prompting the state government to threaten proceeding for criminal defamation.
Mr LEWIS announced his decision to resign only moments before the Labor government
was to introduce a motion of no confidence in him.
He is likely to be replaced by independent MP and deputy speaker BOB SUCH.

19th-Century Censuses Draw Millions to Web; Indicates Strong Family History Interests of North Americans.
SALT LAKE CITY -- People searching their family roots are visiting FamilySearch.org in record numbers since last week's announcement that The Church of Jesus Christ of Latter-day Saints has made the 1880 U.S. and 1881 Canadian censuses available online. New visitor traffic surged immediately to more than 500 percent and remained six to 10 times above normal the following week.
Site administrators attribute the high interest to the growing number of family history enthusiasts, the ease of access provided by online census databases and their value to people seeking information about their ancestors. This morning, visitors to FamilySearch.org continue to pore over the online censuses at a rate of three million hits an hour.
The online availability of the censuses was announced in a press conference by Church President Gordon B. Hinckley on 23 October in Salt Lake City with the Mormon Tabernacle Choir singing "O Canada" and "The Star- Spangled Banner." The announcement was telecast simultaneously to 27 cities.
Within minutes of the announcement, millions of family history enthusiasts searching for elusive U.S., Canadian or British 19th-century ancestors logged on to FamilySearch.org. Television and newspaper stories, as well as Internet news sources, continued to announce the databases throughout the past week.
Users logged on from as far away as Australia. Australian Jan McAlpin said, "I ... found families of my ancestors who I thought I would never be able to trace from Australia, and now I can go back another generation." Another searcher responded: "I am thrilled! I have found umpteen missing ancestors just in the past couple of days."
Elder D. Todd Christofferson, executive director of the Church's family history department, said: "People used to search through rolls and rolls of microfilm with varying degrees of success. Now with just a few keystrokes, they can search through millions of records from home or anywhere they connect to the Internet."
The census makes legendary figures come alive. The Canadian census lists Canada's first prime minister, John A. Macdonald; Ojibwa Chief Jacob Berens; and Anne of Green Gables author Lucy Maud Montgomery. In the U.S. census you can find Mark Twain (Samuel Clemens), William "Buffalo Bill" Cody, the Wright brothers and Alexander Graham Bell.
The Church noted with appreciation the thousands of individuals who volunteered millions of hours over 17 years to create the popular indexes. In total, 85 million names were extracted for the two censuses.

Loeb win confirms class.
The writing was already on the wall, but Sebastien Loeb's fantastic victory at the Wales Rally yesterday confirmed the fact that the BP-Ford Abu Dhabi team had failed to hold onto their WRC manufacturers' title. Loeb's superb come-from-behind win at the Wales Rally showed just what BP-Ford Abu Dhabi had been up against all season. The five-time world champion trailed BP-Ford Abu Dhabi's Jari-Matti Latvala by more than two seconds going into the 19th and final special stage on Sunday. But the the Citroen driver produced one of the drives of the season to beat the overnight leader by 2.7 seconds in the end. And with Loeb's team-mate Dani Sordo finishing third, Citroen picked up the manufacturers' title by as many as 18 points. The French flyer said: "This rally was very difficult. "I didn't like it a lot, but I had a great battle with Jari-Matti and it is unbelievable to have finally won here." Latvala said he did all he could to but that in the end Loeb was just too good. "I tried to drive as fast as I could but it wasn't to be," said a dejected Latvala afterwards. "I really wanted the win but it wasn't easy being first out on the road today - I'm really disappointed." Elsewhere, the UAE's Sheikh Khalid Al Qassimi wrapped up his first full WRC season with an impressive 16th-placed finish in Wales. Admitting the event was his most challenging to date, the Emirati pace ace believes the invaluable experience will serve him well in future rallies. "Just finishing this event feels like a victory," Al Qassimi said. "This is without doubt the hardest WRC event I have ever taken part in - just finding the necessary grip to feel confident in the car was near impossible and it means a lot to me to have reached the finish."
